1/ Purpose of the website

The Website’s purpose is to present the IDA (International Documentation on Audiovisual works) database, a CISAC Tool, administered by SACD and to make available to IDA members and clients specific information such as documentation, tutorials and a calendar of meetings of IDA committees and workshops.

 2/ Acceptance of the terms and conditions of the website

By accessing or using the Website, you hereby accept unconditionally the below terms and conditions. These terms and conditions may be modified or enhanced at any time; you are therefore invited to consult them on a regular basis. These terms and conditions are subject to French law.

3/ Access to the website

The Website may be accessed at the following URL https://www.ida-net.org/en/, 24/7, except in case of supervening event, IT breakdown, maintenance, update or telecommunication issues.

 

The access, information and available services proposed on the Website are free of charge.

 

Some services of the Website are reserved to IDA members or clients and are only accessible from an account authenticated by an identifier and password. Account creation is restricted to IDA members’ and Clients’ representatives, and to other stakeholders allowed to access IDA in compliance with relevant terms and conditions.

 

The identifier and password to this account are strictly personal and confidential. As such, as an IDA member or client representative holding an account, you must reserve exclusive use of it.

Any action performed on the Website through your identifier and password shall be considered as performed by you. You shall be considered the only liable party for any consequence which could result in any disclosure of your credentials to a third party.

You must inform SACD without any delay of any non-authorised usage of your identifier and/or password, and more generally of any breach of safety on the Website that was brought to your attention.

4/ Intellectual Property

The Website as well as any constituent element thereof (text, graphism, software, photography, image, sound, video, map, logo, brand, creation and protectable work, database, etc.) are subject to French and international legislations on intellectual property and, more precisely, on authors’ rights and neighbouring rights law (notably of articles L.122-4 et L.122-5 of the French Code de la propriété intellectuelle and trademark law.

They are the exclusive property of CISAC, except the elements created by external contributors to CISAC and SACD, who have not transferred their intellectual property rights. These terms and conditions do not grant any intellectual property right on the Website or on any constituent element thereof.

Any reproduction, representation, modification, publication, adaptation of all or any part of the Website, by any means or process, is forbidden, without the prior written consent of the owner of the rights.

Subject to notably articles L. 122-5, L. 211-3 et L. 342-3 of the French Code de la propriété intellectuelle, any unauthorised usage of the Website or of any of its constituent element incurs an infringement of intellectual property rights and constitutes a counterfeiting. It can also incur an infringement of image rights, personal rights or any other rights and regulations in force. Its author may therefore be held civilly and/or criminally liable.

5/ Responsibilities

The responsibility of SACD cannot be incurred:

·     In case of interruption of the Website notably for technical maintenance, or content update;

  • In the event of impossibility of access to the online spaces and services, in particular because of technical problems, whatever their origin and source;
  • In case of direct or indirect damage you would suffer, whatever the nature, resulting from the content, access or use of the Website;
  • In the event of abnormal use or unlawful exploitation of the Website. You shall be liable for any damage caused to third parties and for any consequence resulting from a claim or action that may arise therefrom. You also waive the right to take any action against SACD in the event of legal action being taken against you by a third party as a result of the use and/or unlawful exploitation of the Website.

You agree to use the Website in accordance with these general terms and conditions of use and more generally in compliance with current legislation, public order and good morals. You undertake not to transmit any unsolicited advertising or material (“spamming”), or any content containing computer viruses.

Any offence involving automated data-processing systems, as defined in Articles 323-1 to 323-8 of the French Criminal Code or any successor provisions, is punishable by criminal penalties.
